Supreme Court Will Review DACA/DAPA Case


Today, the Supreme Court decided to review the Fifth Circuit’s decision in the Texas lawsuit that blocks implementation of President Obama’s 2014 deferred action initiatives—DAPA and expanded DACA. The Court is likely to hear oral arguments in April 2016. We can expect a decision by the end of June 2016.

    But can we get an explainer on the expanded Question Presented, that deals with the Take Care clause? It’s not just the APA available as a line of attack (with standing being the first weakness, and that it’s not a rule making the second, and prosecutorial discretion the third), but there’s another way the conservative, anti-Obama bloc could reach out to strike down the order.
